IMPORTANT: Shufl is NOT a transportation network company (TNC) or ridesharing service.

We do not provide transportation services, employ drivers, or dispatch rides. Shufl is a coordination platform that allows members of private, trusted family circles to organize rides among themselves. All transportation is provided by private individuals on a voluntary, peer-to-peer basis.

1. Introduction

Welcome to Shufl (the "Service"), provided by KidRide LLC ("Shufl," "we," "us," or "our").

By accessing or using the Shufl mobile application, website, or any related services (collectively, the "Platform"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you may not use the Platform.

2. Definitions

  • "User," "You," "Your": Any person who accesses or uses the Shufl Platform.
  • "Family Circle": A private group of Users who mutually agree to share location information and coordinate rides with one another.
  • "Rider": A User who requests a ride from another User.
  • "Driver": A User who voluntarily provides a ride to another User.
  • "Ride": A voluntary transportation arrangement between a Driver and Rider within a Family Circle.
  • "Minor": A User under the age of 18.
  • "Parent/Guardian": A legal parent or guardian of a Minor User.

3. Eligibility

3.1 Age Requirements

  • To use Shufl as a Rider: You must be at least 13 years old.
  • To verify as a Family Member: You must be at least 13 years old and complete KYC verification (or have parental consent if under 18).
  • To drive other Users: You must be at least 18 years old, possess a valid driver's license, and pass full verification (KYC + background check).

3.2 Parental Consent (COPPA Compliance)

If you are under 13 years old, you may NOT use the Shufl Platform.

If you are between 13 and 17 years old, you may use Shufl ONLY with the consent of your parent or legal guardian.

4. Account Registration

To use Shufl, you must create an account by providing:

  • A valid email address or phone number
  • Your full legal name
  • Your date of birth
  • A secure password

You agree that all information you provide is accurate, current, and complete.

5. User Verification

Shufl uses a tiered verification system:

  • Level 0 (Rider): No verification required. You may request rides but cannot add family members or drive others.
  • Level 1 (Family Member): Identity verification required. Allows adding family members and location sharing. Fee: $3 (valid 24 months).
  • Level 2 (Driver): Full verification (identity + background check) required. Allows giving rides to family members. Fee: $5 (valid 12 months).

Background Check Consent (Level 2 Drivers)

By requesting Driver verification, you authorize Shufl to obtain a consumer report (background check) about you. This report may include criminal records, motor vehicle records (MVR), and sex offender registry checks.

6. Platform Use

6.1 Permitted Use

You may use Shufl to:

  • Create a Family Circle with trusted individuals
  • Share your real-time location with Family Circle members
  • Request rides from verified drivers in your Family Circle
  • Provide rides to riders in your Family Circle (if Level 2 verified)
  • Track rides in progress (if authorized by rider)
  • Use emergency SOS features

6.2 Prohibited Use

You may NOT:

  • Use Shufl for commercial ride-hailing or public ridesharing
  • Accept payment for rides beyond IRS-compliant mileage reimbursement
  • Add strangers or unknown individuals to your Family Circle
  • Share your account with others
  • Provide false information during registration or verification
  • Harass, threaten, or abuse other Users
  • Use Shufl for any illegal purpose

7. Rides & Transportation

7.1 Shufl is NOT a Transportation Provider

Shufl does not:

  • Provide transportation services
  • Employ, contract with, or dispatch drivers
  • Own, operate, or maintain any vehicles
  • Control when, where, or how rides occur
  • Guarantee ride availability, safety, or quality

Shufl is a coordination platform only. All rides are voluntary, private arrangements between Users within Family Circles.

7.2 Driver Responsibilities

If you provide rides as a Driver, you are solely responsible for:

  • Ensuring you have a valid driver's license and vehicle insurance
  • Maintaining your vehicle in safe operating condition
  • Obeying all traffic laws and regulations
  • Providing safe and respectful transportation
  • Your own taxes, insurance, and vehicle expenses

7.3 Reimbursement

Drivers may request reimbursement for rides at the current IRS standard mileage rate. Reimbursement is optional and mutually agreed upon between Driver and Rider. Shufl does not take a commission.

7.4 Insurance

You are solely responsible for maintaining adequate insurance coverage.

For Drivers: Your personal auto insurance policy must cover ridesharing or carpool activities. Shufl does not provide insurance for drivers or vehicles.

8. Safety Features

8.1 Emergency SOS

Shufl provides an Emergency SOS button that allows you to send your real-time location to your emergency contacts. By using this feature, you authorize us to access your device location and send SMS/push notifications to your emergency contacts.

The SOS feature is a convenience tool only. It does not replace calling 911 in a true emergency.

8.2 Family Tracking

If you enable family tracking, you consent to sharing your real-time location with Family Circle members.

You may disable family tracking at any time in Settings (if you are 18 or older). Minors under 18 cannot disable family tracking or ride notifications (COPPA requirement).

9. Payments & Fees

9.1 Verification Fees

  • Level 1 (KYC): $3 (one-time, valid 24 months)
  • Level 2 (Driver): $5 (one-time, valid 12 months)

Verification fees are non-refundable, even if verification is rejected.

9.2 Payment Processing

All payments are processed securely through Stripe. By making a payment, you agree to Stripe's Terms of Service and Privacy Policy.

10. Privacy & Data

Your use of Shufl is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using Shufl, you consent to receive transactional SMS and push notifications (ride updates, emergency alerts), service-related emails, and marketing communications (if you opt in).

11. Assumption of Risk

You acknowledge that rides coordinated through Shufl are private arrangements between individuals. By participating in rides (whether as a driver or rider), you assume all risks associated with such rides, including but not limited to risks arising from the conduct of other users, vehicle conditions, traffic, weather, and accidents.

12. Disclaimers & Limitation of Liability

12.1 No Warranty

The platform is provided "as is" and "as available" without warranties of any kind, either express or implied.

We do not guarantee that the Platform will be error-free, uninterrupted, or that rides will be safe, timely, or available.

USE OF THE PLATFORM IS AT YOUR OWN RISK.

12.2 Limitation of Liability

To the maximum extent permitted by law, Shufl shall not be liable for:

  • Any accidents, injuries, or deaths arising from rides
  • Any property damage or theft
  • Any disputes between Users
  • Any loss of data or service interruptions
  • Any indirect, incidental, consequential, or punitive damages

13. Indemnification

You agree to indemnify, defend, and hold harmless Shufl from any claims, damages, losses, or expenses arising from your use of the Platform, your violation of these Terms, or your provision/receipt of rides.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms, misuse of the Platform, or for safety or legal reasons. You may also terminate your account at any time by contacting us at support@shuflride.com.

15. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Florida.

Arbitration Agreement

Any dispute arising from these Terms or your use of Shufl shall be resolved through binding arbitration. By agreeing to these Terms, you waive your right to a jury trial.

Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive your right to participate in class actions, class arbitrations, or representative actions.

16. Special Provisions for Minors (COPPA Compliance)

Children under 13 may NOT use Shufl.

Minors aged 13-17 may use Shufl only with verifiable parental consent.

Parents/Guardians of Minors have the right to:

  • View their child's ride history
  • See their child's real-time location
  • Receive notifications about all rides
  • Disable the child's account at any time
  • Request deletion of the child's data

Minors cannot disable family tracking, ride notifications, or emergency features.

Acknowledgment

By clicking "I Agree" or using Shufl, you confirm that you have read, understood, and agree to these Terms, acknowledge that Shufl is not a transportation provider, and accept full responsibility for rides you provide or take. If you are a Parent/Guardian, you consent to your child's use of Shufl.
